I – General Conditions of Sale

 

Any purchase of entry fees made at the Maison de l’Eau et de la Méditerranée is exclusively governed by these Conditions of sale.

 

ARTICLE 1 : ACCEPTANCE OF THE PRESENT GENERAL CONDITIONS OF SALE

 

The customer  acknowledges having read these General Conditions of sale before the validation of his order. Any validation of the order implies acceptance of the general conditions without exception. As a result, the customer declares and acknowledges having perfect knowledge of it and therefore waives any other document. Any confirmation of an order implies acceptance of the general conditions without exception. Hence, The Buyer declares and recognizes to have a perfect knowledge of it and renounces therefore to take advantage of any other document.

 

La maison de l’Eau et de la Méditerranée reserves the right to adapt or modify at any time these conditions of sale. In case of modification, the General Conditions of Sale that are in force on the date of the order shall be applied.

ARTICLE 3 : TICKETS AND SUBSCRIPTIONS

The entrance fee for the Maison de l’Eau et de la Méditerranée takes the shape of a daily admission ticket.

3.1 Services to which entry fees give entitlement

Entrance tickets are valid for access to the Maison de l’Eau et de la Méditerranée

3.2 Ticket validity

All tickets are valid only for the current year. The conditions of use of the entrance fees are detailed in Article 8 of these General Conditions of Sale.

ARTICLE 4 : RATE OF ENTRANCE FEES

Reduced rate tickets and free tickets are available upon presentation of documentary proof issued less than six months previously, :

 

  • During the purchase at the reception desk of the ticket office of the Maison de l’Eau et de la Méditerranée upon presentation of an invalid documentary proof, the visitor will not be able to aim for the free or reduced rate tickets.
  • During access control upon presentation of an invalid documentary proof, the visitor will not be admitted in the Maison de l’Eau et de la Méditerranée.

 

All payments will be in € (euros) all taxes included.

 

The Maison de l’Eau et de la Méditerranée reserves the right to modify its rate at any time upon deliberation of its Board of Directors.

 

ARTICLE 5 : SALES CHANNELS

Article 5.1 Electronic tickets

See Chapter II on the specific conditions for online sales.

Article 5.2  The ticket office at the counters of la Maison de l’Eau et de la Méditerranée

Entrance tickets are issued at the counters :

Until one hour before the Maison de l’Eau et de la Méditerranée closes

All modes of payment, as provided for in the deliberation of the imprest account and receipts of the ticket office, are granted at the counters.

ARTICLE 6 : GROUPS

The Maison de l’Eau et de la Méditerranée is open to groups of at least ten persons and cannot exceed twenty-five persons

 

Beyond this number, a second time slot will be proposed. Any responsible for the group coming in with a number higher than the number indicated on the booking confirmation may be denied the visit.

Groups visits must imperatively be reserved :

 For the visits with mediation or workshop, at least a month before the date of visit. For self-directed visits (without mediation but with speaking), no later than the week preceding the expected date of the visit. For self-directed visits (without speaking), at the latest, the day before the desired date of the visit.

The offers allow groups to discover the Maison de l’Eau et de la Méditerranée at any age with an intermediary, independently. The choice of the visit or the course is made at the booking. The visit schedule is indicated on the booking confirmation. The group will have to go to the reception counters fifteen minutes before the beginning of the visit. Any reservation to visits or workshops will respect the allocated time.

In case of lateness, the group leader must inform the animation department at the following number : 000000000. In case of lateness of less than fifteen minutes, the visit will be shortened. Beyond fifteen minutes, the visit is no longer guaranteed.

Some cultural activities can be programmed specifically for groups. Other activities are for everyone and at the same time, a quota for groups can be defined. In either case, group leaders should contact the group reservations department.

ARTICLE 7 : TERMS AND CONDITIONS OF PAYMENT FOR GROUPS

In order to organize in good conditions the reception of the groups, and to foresee in a sufficient time of the cultural facilitators for the workshops and the visits, the Maison de l’Eau et de la Méditerranée is obliged to demand very precise terms and conditions of payment.

Also, apart from entrance fees for workshops and / or visits with mediation must imperatively be paid not later than 15 days before the day of the visit at the Maison de l’Eau et de la Méditerranée. Entrance tickets can be paid on the day of the visit, at the counter (see article 5.2), by credit card or by check.

If the group doesn’t pay on this date, the booking of the workshop and / or visit will be canceled.

Groups can pay by cash, bank transfer, check or credit card. Only public institutions can pay by administrative money order, but, it is imperative to indicate it at the time of booking so that you will be given the form for this payment method.

 

ARTICLE 8 : CONDITIONS OF USE OF THE ENTRANCE FEES

8.1 Control of entrance fees

All entrance fees are systematically checked.

 The visitor with a purchased entrance fee can access the exhibition halls, to workshops and / or to the 3D projection room, according to the area(s) to which their entrance fee gives access to.

Only entrance fees with perfectly legible mentions are accepted. Any partially printed, soiled, damaged or illigible entrance fees can not be accepted. For m-tickets, any scatched, damagad smartphone screen of with lighting problems will be refused at the time of access control.

The entrance fee is personal and non-transferable.

The Maison de l’Eau et de la Méditerranée  reserves the right to refuse any access in case of presentation of an entrance fee that does not respect one of the conditions as set out above.

8.2 Respect of visitors’ rules

Visitors are required to the rules of visit of the Maison de l’Eau et de la Méditerranée, which can be consulted at the counters of the Maison de l’Eau et de la Méditerranée or on mem-leboulou.fr. Any visitor who does not respect the rules of visit of the Maison de l’Eau et de la Méditerranée may be denied access to the place without being able to claim reimbursement of their entrance fee.

 

8.3 Terms of use of entrance fees

In the event of peak times in the Maison de l’Eau et de la Méditerranée, a waiting time is possible at the entrance.

Concerning  the entries for the cultural activities of the Maison de l’Eau et de la Méditerranée :

  • The entrance ticket is only valid for the cultural activity of the day and hour selected
  • The entrance ticket entitles you to a single entry
  • The entrance ticket must be kept until the end of the cultural activity
  • Positioning in the projection room is free, imperatively seated (chair or folding seat)

 

ARTICLE 9 : FRAUDULENT USE – LOSS – THEFT OF THE ENTRANCE TICKET

9.1 Fraudulent use of the entrance ticket

The Maison de l’Eau et de la Méditerranée will refuse access to the site to any holder of an entrance ticket with a barcode that has already been scanned. Only the first person with an entrance ticket will be admitted. They will be presumed legitimate holder of the entrance fee, the buyer being legally responsible for the copies made, including from his mailbox.

9.2 Loss and theft of the entrance fee

The Maison de l’Eau et de la Méditerranée disclaims all responsability in the event of loss or theft of the right(s) delivered, including within the enclosure of the site.

ARTICLE 10 : REPAYMENT CONDITIONS AND EXCHANGE OF ENTRANCE FEES

10.1 Withdrawal period

In accordance with Article L 121-20-4 of the French Code of Consumption,  the purchase of an entrance fee can not be withdrawn

10.2 Exchange and cancellation

Entrance fees delivered can not be exchanged or refunded, except in the event of cancellation by the Maison de l’Eau et de la Méditerranée of the service concerned by the entrance fee under the conditions defined in the Article 10.3

10.3 Cancellation of the Maison de l’Eau et de la Méditerranée of the service on the entrance fee

Due to safety requirements, the Maison de l’Eau et de la Méditerranée reserves the right to close its doors, cancel a service or change its opening hours.

The Visitor Reception service will contact the buyer as soon as possible by any authorized means (SMS, email…) and / or through the press to inform them of the cancellation of a service and propose them :

  • Promptly, the postponement of the service to a different day and / or time
  • Otherwise, the refund of the concerned entrance fee specifying terms and conditions

ARTICLE 11 : VISITING MATERIALS

11.1 Media for the digital application

The app of the visit is downloadable for free on smartphone.

Within the limits of the available stocks, the visitor not having smartphone can, against a deposit cheque covering the value of the material, obtain free of charge from the reception of the Maison de l’Eau et de la Méditerranée the loan of a digital tablet. The identity document of the borrower will be scanned and kept until the return of the material.

The loan of this tablet opens right only to the use of the aforementioned application

ARTICLE 12 : RESPONSABILITY

12.1. For services

In accordance with Article L. 121-20-3 of the French Consumer Code, the Maison de l’Eau et de la Méditerranée can not be held under any circumstances  for any non-performance or improper performance of the services associated with the entrance fees that would be attributable to the fact of the buyer or visitor, to the unpredictable and insurmountable event of a third party or to a case of force majeure as defined in Article 13 of these general conditions of sale.

12.2 For the issue of entrance fees

Except dysfunctional ticketing software that would be attributable to it, the Maison de l’Eau et de la Méditerranée can not be held responsible for any anomalies that may occur during the ordering, processing, downloading or printing of the ticket, attributable, either to the fact of the purchaser, or to the unpredictable and insurmountable fact of a third party foreigner to the service, or to a case of force majeure as defined in Article 14 of these general conditions of sale.

ARTICLE 13 – FORCE MAJEURE

The Maison de l’Eau et de la Méditerranée can not be held responsible for any non-compliance resulting from a case of force majeure considered as such by the jurisprudence of French courts and tribunals.

ARTICLE 14 – PROOF, CONSERVATION AND ARCHIVING

The computerized registers, kept in the computer systems of the Maison de l’Eau et de la Méditerranée or by any service provider of the latter, under reasonable conditions of safety will be considered as proofs of sales contract, its date, orders and payments made.

The archiving of orders and of invoices is carried out on a reliable and durable support so as to correspond to a faithful copy, in accordance with the article of the Civil Code.

ARTICLE 15 – PROTECTION OF PERSONAL DATA

When placing the order on the internet or when buying entrance fees at the counters of the Maison de l’Eau et de la Méditerranée, personal data are requested from the buyer (name and surname of the visitor, postal address, email address and telephone number). These data are necessary for the processing and the follow-up of this order and are also used in the event of a possible postponement or cancellation of the service which provides access to the entrance fee.

Personal data collected is processed by the Maison de l’Eau et de la Méditerranée, in accordance with the legal provisions relating to the protection of personal data from the law n ° 78 – 17 of January 6, 1978, called « Informatique et Libertés » :

  • The buyer is informed that this authorized processing of personal data has been the subject of a declaration to the National Commission for Data Protection and Liberties

 

  • The buyer has at any time a right of access, modification, correction and deletion of personal data

ARTICLE 16 – ENTIRETY OF THE GENERAL CONDITIONS OF SALE

The buyer and the Maison de l’Eau et de la Méditerranée accept that the present General Conditions of Sale constitute the entirety of the agreement reached between them.

If, for any reason, any of the clauses of these General Conditions of Sale should be declared inapplicable, it would then be considered as unwritten without causing the nullity of these General Conditions of Sale, nor alter other measures.

Any order for entrance fees made on http://www.mem-leboulou.com,  website of the Maison de l’Eau et de la Méditerranée is exclusively governed by these terms and conditions of sale.

ARTICLE 18 – ACCEPTANCE OF THESE GENERAL CONDITIONS OF SALE ONLINE

The buyer acknowledges having read these General Conditions of Sale before the validation of the order. Any validation of the order implies acceptance of the General Conditions of Sale without exception. As a result, the buyer declares and acknowledges having perfect awareness of it and therefore waives any other document.

The Maison de l’Eau et de la Méditerranée reserves the right to adapt or modify at any time this General Conditions of Sale. In case of modification, only the General Terms and Conditions of Sale in force on the day on the order shall apply.

ARTICLE 19 – ONLINE TICKETS

The reception service is at your disposal for any question concerning the use of the website, the services associated with the entrance fees, their conditions of use as well as the terms of ordering and delivery.

ARTICLE 20 – ENTRANCE FEES FOR SALE

20.1 Benefits to which entrance fees are entitled.

Tickets available on http://www.mem-leboulou.com  are valid as individual:

  • Either for entries to the exhibitions (permanent course)
  • Either for cultural mediation activities (workshops, guided tours …)

However, exhibition fees for young people up to the age of 18 can be printed via the website once an adult entrance fee has also been purchased (maximum 4 children).

In addition, the Maison de l’Eau et de la Méditerranée offers the possibility for adult visitors to buy a number of entrance fees at the group rate if the number is between 10 and 29. In case of speaking, the reservation is obligatory.

However, for the groups benefiting from a specific price, the group leaders must necessarily address the animation service at the latest one week before the estimated date of visit.

20.2 Validity period of entrance fees

Each entrance ticket issued is valid for the current year. The conditions of use of the entrance fees are detailed in Article 8 of these General Conditions of Sale.

ARTICLE 21 – PRICES OF VISITS AND AMOUNT OF THE ORDER

The total price during the order validation is the final price. Ticket prices and the total price of the order are indicated in euros, all taxes included.

 The Maison de l’Eau et de la Méditerranée reserves the right to modify its prices at any time.

ARTICLE 22 – PLACING AN ORDER

The main stages for placing your oder are described below :

1 / The buyer selects the service of his choice

The buyer selects the number of tickets per price and knows in real time while ordering the availability of tickets. This is written in the basket.

2 / In order to place an online order, the buyer must create an account on the Website : www.mem-leboulou.com or must connect to the account if it has already been created beforehand. The creation of the account means the communication of necessary and required information : name and surname, phone, email address and geographical origin.

3 / The summary resuming the entire order is displayed.

Moreover, before validating and paying for your order, the buyer will be requested to review these General Conditions of Sale, which the buyer must expressly accept. To order, the buyer will be requested to enter the bankcard number, the expiration date and the security code (last three figures on the back of the bankcard)  In case of refusal by the payment center, the order is automatically canceled. Any payment of the order by the buyer constitutes an irrevocable acceptance of the order which can not be called into question.

4 / Entrance tickets ordered from the website must be printed by the buyer (see print conditions below). The buyer will also receive a link by email to allow them to log into their personal space on the website : www.mem-leboulou.comand print their E-tickets at a later date. It is not possible to print E-tickets at the ticket office.

The buyer is responsible to ensure that the details provided when ordering are correct.

5 / To get tickets

E-tickets can be printed as soon as the purchase is confirmed. E-tickets can also be downloaded in M-ticket form and presented for control on a mobile device. E-tickets must be printed in advance .

They must be printed on white A4 paper, which is blank on both sides, with no alteration to the printed size and in portrait format (vertically).  In the event of an incident or poor print quality, you should print your file again. Before ordering, buyers must ensure that they have the appropriate software and hardware configuration to print their e-ticket : namely a computer connected to the internet on which Acrobat Reader version 8 is installed, and a printer.

For the download of the ticket on mobile phone : If the buyer chooses to download the entrance fee on mobile phone, the buyer will have to make sure that the phone is optimized for the display of the m-ticket. Moreover, the buyer will not be able to mention the loss, the theft, or the malfunction of the mobile phone at the time of the presentation of entrance ticket to the access control.

In either case, the barcode associated with the entrance fee must not be subtracted from the optical scanner at the entrance of the exhibition.

ARTICLE 23 – PAYMENT

23.1 Payment method

Payment of entrance fees must be paid in euros and by bankcard. The Maison de l’Eau et de la Méditerranée accepts cards from the « CB » network, Visa, Eurocard and Mastercard.

23.2 Payment transaction

Your bankcard will be debited at the time of the transaction.

23.3 Payment advice

As soon as the transaction is completed, the buyer is informed on the browser window that gave rise to the secure request. The buyer will also receive an email confirmation of purchase.

The buyer will also receive a link by email to allow them to log into their personal space on the website : www.mem-leboulou.com and print their payment advice.

23.4 Security of payments

For any payment made when ordering entry ticke (s) on www.mem-leboulou.com, The Maison de l’Eau et de la Méditerranée uses a secure online payment system to encrypt the credit card number of the buyer via SSL (Secure Socket Layer).

ARTICLE 24 – ORDER CONFIRMATION

From confirmation of payment by the payment center, the buyer receives an email confirming the order from the online ticket office of the Maison de l’Eau et de la Méditerranée. The confirmation email is worth « acknowledgment of receipt » of the order and contains the following information :

  • The essential characteristics of the entrance fees sold
    • The unique transaction number
  • The total amount of the order

 

Once the order is confirmed, entrance fees are available at any time in the personal space of the buyer, on the online ticketing site : www.mem-leboulou.fr

 

ARTICLE 25 – RESPONSIBILITY

 

Except dysfunction of the site www.mem-leboulou.fr which would be attributable to it, the Maison de l’Eau et de la Méditerranée can not be held responsible for the anomalies that can occur during the order, the treatment, the download or the printing of the ticket, attributable either by the way of the buyer, or to the unpredictable and insurmountable of an unknown third party  to the service, or to a case of force majeure as defined in Article 12 of these General Conditions of Sale.

 

ARTICLE 26 – PROOF, CONSERVATION AND ARCHIVING

 

The computerized registers, kept in the computer systems of the Maison de l’Eau et de la Méditerranée or by any service provider of the latter, under reasonable conditions of safety will be considered as proofs of the contract of sale, its date, orders and payments made. The filing of orders and invoices is carried out on a reliable and durable support so as to correspond to a faithful copy, in accordance with the article of the Civil Code.

 

ARTICLE 27 – COOKIES

 

To facilitate your navigation on the site www.mem-leboulou.fr , the Maison de l’Eau et de la Méditerranée uses « cookies ». These files, recorded on the hard disk of the terminal used are intended to signal the visit of the latter on the site referred to above, when consulting other pages of the site or during a new visit and to record navigation information (pages viewed, date and time of consultation). The buyer has a right of access to information thus collected, rectification and deletion under the conditions set out in Article 14.
